Le Parti Pirate, qui peut être qualifié d’ “historique”, regrette la confusion avec laquelle les journaux en ligne ont présenté notre mouvement, le décrivant comme divisé.

Nous sommes atterrés de la piètre qualité de ces informations non documentées ni vérifiées, et de leur manque de professionnalisme journalistique.

Le Parti Pirate appelle également les initiateurs du PPF à accepter dorénavant de communiquer avec nous avant d’alerter la presse, étant donné que notre mouvement est un parti politique depuis que nous avons un candidat à l’élection législative partielle des Yvelines, à la différence du PPF qui n’est qu’une association et porte préjudice à l’ensemble de notre campagne électorale.

Le Parti Pirate est d’autant plus le seul organisme français qui soit reconnu par le Parti Pirate francophone, le Parti Pirate International et le Parti Pirate suédois.

A ce titre, nous souhaitons élever le débat et sortir de cette confusion politico-médiatique, qui ne sert que la cause de nos adversaires, obscurantistes et superficiels.

En effet, la Loi Hadopi va sans doute être enregistrée à l’Assemblée Nationale le 15 septembre, consacrant la guerre de l’industrie culturelle contre le partage, assistée par le gouvernement.

Nous tenons à relayer le message de Richard Stallman, qui lance un appel à “En finir avec la guerre au partage” (http://tinyurl.com/nh5e2q).

Le Parti Pirate s’aligne sur cette pensée, le partage, comme le don, est une composante fondamentale de l’être humain, universelle.

Le combat du consortium des majors est inutile et cours au désastre économique, politique, mais surtout culturel, raison pour laquelle nous devons au moins essayer de les en empêcher.

Il est anormal que ces pratiques monopolistiques illégales qui flouent les règles de libre concurrence ne soient pas punies par la justice grâce au soutien politique de lobbys corrupteurs.

Sur le fond, notre réflexion suit tout à fait celle de Stallman, même si les débats sur les différentes formes de contestations possibles sont très présents au sein de notre mouvement.

De nombreuses personnes partagent nos idées, représentées par des communautés, des associations ou de simples citoyens.

Nous nous inscrivons dans un mouvement d’ensemble, international, et ne pouvons pas tolérer que nos idées soient occultées par une théâtralisation médiatique politicienne alors que nos libertés fondamentales sont menacées.

Odile Ambry, présidente de l’L'Internet Society (Isoc), une structure internationale, représentée en France par l’ Isoc-France, nous fait remarquer que “si Hadopi 2 était en vigueur aujourd’hui, l’accès au Net de milliers de familles pourrait être suspendu et leurs enfants privés de facto du droit à l’éducation.” http://tinyurl.com/nz5r4a

La privation de l’accès à Internet est en effet privatrice de culture et d’éducation, c’est à dire en totale contradiction avec notre constitution, comme l’avait pourtant rappelé le Conseil Constitutionnel. Les citoyens ont le droit de prendre part à la vie culturelle, de s’instruire et de communiquer, universellement et fondamentalement. Par essence.

C’est pourquoi, la logique répressive d’Hadopi est vouée à l’échec, de par sa contradiction intime avec un régime démocratique, tout comme les facilités de surveillance et de filtrage instaurées par la Loi Loppsi. Ces Lois semblent inspirées du modèle chinois, et nous inspirent la plus grande crainte pour l’avenir de notre culture, de notre création, de l’investissement de notre société dans des valeurs éducatives, culturelles.

Le Parti Pirate veut interpeller l’ensemble de la société sur la question des libertés fondamentales, du Droit à la Culture et du Droit à l’Education.

Nous proposons ainsi de suivre les traces du Parti Pirate International en prenant les trois points historiques du Parti Pirate International comme point de départ pour étendre une réflexion politique transversale, participative et ouverte :

• La réforme des droits d’auteur dans le domaine culturel est indispensable afin de préserver nos créations culturelles de l’effondrement structurel de l’industrie culturelle, induit par l’obsolescence d’un modèle économique fondé sur des biens matériels comme les disques audios, à l’heure de la virtualisation des copies numériques.
• En matière d’éducation, le parti pirate prône la libre circulation des savoirs scientifiques, et souhaite l’abolition des brevets logiciels et des brevets sur le vivant.
• La lutte pour la préservation des libertés fondamentales comme la vie privée est essentielle et implique une réflexion éthique sur l’utilisation des technologies comme la vidéo surveillance, la biométrie, le filtrage d’Internet, etc.

Ces trois points sont simples à expliquer autour de vous, et permettent de suivre une réflexion politique d’ensemble.

La diversité culturelle n’est pas assurée par le système culturel actuel, qui formate et néglige le talent, la virtuosité. Cette diversité ne peut pas non plus être assurée, dès lors que la culture est réservée à une élite, inaccessible au plus grand nombre par son prix.
Ce même système ne rémunère pas non plus l’immense majorité des artistes, mais seulement quelques privilégiés sélectionnés sur des critères commerciaux.

Il est temps de changer de modèle économique, mais également de prendre du recul et d’observer les valeurs dans lesquelles notre société investit.
La culture, l’Education, la Science, sont de grandes forces stratégiques, économiques et humaines, et il serait dangereux dans notre intérêt commun de les remplacer par des valeurs financières et politiciennes.

Il n’est pas juste que des entreprises privées refusent au public l’accès à une technologie pour sauvegarder les rentes des actionnaires, où qu’elles s’approprient une technologie fondée sur les valeurs de partage et création.

Le Parti Pirate croit aux valeurs universelles, aux droits de l’homme et au progrès.
Ce sont ces idées que nous souhaitons partager avec tous les citoyens, en les invitant à participer à la réflexion à nos côtés, en collaboration et à la mesure des possibilités de chacun.

Depuis quelques jours, un site cherche à récupérer le mouvement Pirate dans son ensemble, en occupant le terrain en particulier sur Facebook.

En réponse, nous tenons à faire un point sur l’historique du Parti Pirate.

Tout d’abord,  il n’a jamais été membre du Parti Pirate et n’a jamais été l’initiateur de quoi que ce soit.

Le Parti Pirate a été créé en 2006 par un rassemblement de citoyens qui cherchent à défendre leurs droits, leurs vies privées et la liberté d’expression, à l’ère du numérique.

Indépendant, ouvert à toutes et tous.

Nos objectifs sont et ont toujours été :

• Nous battre pour la liberté d’expression
• Nous battre pour le respect de la vie privée
• Nous battre pour la liberté de partager les savoirs, la culture, les opinions…
• Protéger les droits universels à l’ère numérique
• Protéger les usages non-commerciaux du web
• Promouvoir un internet pour toutes et tous
• Combattre les BigBrothers et SmallBrothers (videosurveillance, RFID, biotech…)
• Combattre les invasions du copyright
• Combattre les brevets
• Combattre le lobbying dans les questions publiques

Malgré un Hard reset qui à eu leu en 2007, donnant naissance à deux branches du Parti Pirate suite à des divergences d’idées, nos objectifs aux uns et aux autres n’ont jamais changés. C’est pourquoi depuis presque 1 an, nos deux partis étaient en discussion pour s’unifier. Cette réunion définitive est effective et avérée à ce jour.

Aucune personne extérieure à nos deux mouvements n’a joué aucun rôle dans notre réunification. Les lauriers qu’il s’attribue à ce sujet sont totalement usurpés.

Nous tenons donc à informer tout un chacun que la personne qui s’autorise à parler en notre nom, à se servir de nos actions (en particulier notre participation aux élections législatives), de nos affiches qu’il n’a rien à voir avec le Parti Pirate actuel.

The decision of the French Constitutional Council of the last June 10 was one more victory for digital freedoms, after the election of the first Pirate Parliament Euro-deputy.

Censorship of the principle of graduated response by the Constitutional Council was intelligent decision.
This decision is from our point of view legitimate and justified.
By upholding the appeal filed against the law “Creation and Internet”, the Constitutional Council reinforces many of our convictions.

Indeed, the privacy is at the heart of the concerns of the Pirate Party.
Monitoring of Internet connections is a breach of human rights and citizens, especially the universal right to expression and communication. Communicating is a vector of development for all and should be accessible to everyone and it can deprive citizens without solid legal basis.
History has shown that botched justice is nonsense and does the resentment of citizens.
The Constitutional Council has agreed that all sanctions must be taken by a judge and not by a pseudo public administrative entity controlled by lobbyists. The independent justice has won the fight against the principle of “judge and party.”

The recognition of the right to access the Internet as a human right is a historic event. We are still facing to the consequences of that decision by extending this recognition to the right of free sharing of culture. This right goes hand in hand with the remuneration of artists, which is not fully secured by intellectual property, since very few artists are paid.

Respect for the presumption of innocence is another important point in this decision. By making the proof beared by the internet owner (with all abuses as consequence, government spyware and other), the legislature has violated this principle and it is only right if this part of the law has been simply censored.

Today, the Law “Creation and Internet” is emptied of substance but the government refuses to see the reality. How much defeat must it takes in order to make the government understand that this law is a failure ?
We will remain vigilant on the way that this affair could go.
The government will have again many opportunities to interfere with the freedoms of Internet users, we must remain each time mobilized to resist facing the surveillance of networks.

Let’s talk about the future now. The law known as Loppsi 2 is coming and probably the Government will make it an emergency, which would lead him back to the vote of simplified botched procedures that everyone knows. We still have a chance to prevent this law from passing. We need to alert and inform citizens about the risks that exist when filtering the Internet, so that France will never look like China. We must defend our digital freedom, which are fundamental, and act.
This government has no legitimacy to restrict civil and digital liberties.

The Pirate Party needs new forces to spread the need of justice and freedom.
We are calling all the pirates of France to fight under the banner of the 3 historical points of the International Pirate Party : Reform of Copyright, Free movement of scientific knowledge and promotion of Human Rights.

The French Pirate Party Historical Channel wants to congratulate the Swedish Pirate Party for his new Euro-deputy, Christian Engström.

This election is a victory for the International Pirate Movement, which will finally be able to disseminate its ideas into politics and media in a legitimate way.

We can see a positive sign of conscience and a hope for the universal dissemination of cultural works, the free flow of scientific knowledge and respect of fundamental rights of citizens.

Pirate Party ideas are full of potential, innovation and imagination, they are likely to deeply change political and economic dogma. They are particularly useful today and are expected to spread across the globe.

The Earth can no longer simply focus on an economic development without rationality or limits..

The French Pirate Party historical channel gives all its support to the administrators of the The Pirate Bay website, sentenced to a year of jail and told to pay 3 million Euro of damages in unworthy conditions of a State of law.

The FPPch condemns firmly the interference of copyright lobbies in state justice and democratic process.

After the revelation of links between the judge Thomas Norström and the intellectual property lobbies, FPPch asks the cancellation of The Pirate Bay sentence according to the Right of a fair trial.

The membership of the Svenska föreningen för upphovsrätt (Swedish association for the Copyright), and being councilman of Svenska föreningen för industriellt rättsskydd (Swedish Association for the Protection of Industrial Property) is obviously not compatible with the function of judge in The Pirate Bay lawsuit, because of a conflict of interest.

The judge Norström, by being member of these lobbies as are the counsels for the prosecution Henrik Pontén, Peter Danowsky and Monica Wadsted, who represented the disc and movie industry during all litigation, is corrupted.

Any other decision than the cancellation of this judgment would be a denial of justice and democracy.

The Pirate Party French-historical channel makes common cause with the Swedish Pirate Party in their battle for the broadcasting of culture to all.

The FPPch calls all actors of the web and political life to unite at European level to report the corruption of parliamentarians and judges by lobbies.

Finally, FPPch calls all French web-users to rally against the Hadopi law and to express their opposition in the whole country on Saturday, April 25th.

MEPs voted against the principle of the FNAC Olivennes law

We take good note of this rejection by MEPs about these repressive measures planned by the mission FDI/FNAC/Olivennes.

We advise some citizen’s associations which are still present in this organization to leave as soon as possible, especially after dark conditions that led to the re-election for a third consecutive election of her president …..

The FDI/FNAC/Olivennes mission has led to the signing of agreements between ISPs, culture manufacturers, and government, with two consequences: the immediate start of collaboration between ISPs and the current government regarding the setting of a mass repression by experimenting filtering, and the announcement of a project to establish a graduated response (user’s unsubscribing, including telephone and television, while continuing to pay subscriptions) .

We ask Christine Albanel to withdraw his project, which has been clearly rejected by the European Parliament.
We also ask ISPs to immediately stop any filtering tests to serve the entertainment lobbies.
