The Parti Pirate and the Parti Pirate Canal Historique are pleased  to announce you the coming launching of their new common interactive platform, another symbol of their united strength.

Fostering the dialogue, listening to people and encouraging a spirit of initiative: all these efforts were crucial to the fusion of our two entities.
We would like to thank all our members and staff for their true devotion to the union of the French Pirates.
This is the reward of your commitment.

The French PP is now one and whole, and more than ever ready to take part in the future election campaigns coming soon! (In fact, we are already running one of them!)

We’ll give our full support to all the associations involved in the protection of citizens’ rights ; citizens being nowadays more and more considered as potential suspects by our institutions, which promulgate laws destroying freedom in France as well as in other places.

Release Odebi 27-10-2008: Call the french senators to reject the graduated response!

ODEBI sent the following message to the french senators, and calls all internet users to ask the french senators to reject the graduated response:

French senators must realize that the graduated response is a repressive mechanism totally contrary to the most basic rights of citizens:

- Every citizen has the right to a fair trial before any penalty: it is the independent and impartial judge, and he alone, which is the guardian of freedoms.

- Freedom of expression and information is a fundamental right: it is scandalous that the Committee of Cultural Affairs of the Senate tries to deny it by saying that no european text says that Internet access is a fundamental right . The internet access allows to exercise this freedom of expression and information: terminating access is therefore a clear violation of this freedom. This punishment is completely disproportionate.

- The Committee of Cultural Affairs said that only the “home” access will be terminated: it is therefore a familial punisment. No democracy can accept the infliction of such collective punishment, which was recalled by the former french prime minister Michel Rocard on 22 April 2008: “For me, the possible cutoff of the Internet is a collective punishment prohibited by all our systems of law. The meaning of the laws is clear and there is no sophisticated problem to understand that. ”

French senators must ensure that:

- Only the judge can decide on a punishment.

- Terminating access of families, ie imposing a collective punishment, must be clearly prohibited.

MEPs voted against the principle of the FNAC Olivennes law

We take good note of this rejection by MEPs about these repressive measures planned by the mission FDI/FNAC/Olivennes.

That mission who was to determine how to filter and unsubscribe users was led by the CEO of FNAC: its conclusions are tainted by a conflict of interest. The President of IDF (Rights Forum on the Internet), an association of “co-regulation” and then supposed to be independent, had also agreed to participate to this mission: while doing that, she has also accepted the idea of filtering and unsubscriptions.
We advise some citizen’s associations which are still present in this organization to leave as soon as possible, especially after dark conditions that led to the re-election for a third consecutive election of her president …..

The FDI/FNAC/Olivennes mission has led to the signing of agreements between ISPs, culture manufacturers, and government, with two consequences: the immediate start of collaboration between ISPs and the current government regarding the setting of a mass repression by experimenting filtering, and the announcement of a project to establish a graduated response (user’s unsubscribing, including telephone and television, while continuing to pay subscriptions) .

We ask Christine Albanel to withdraw his project, which has been clearly rejected by the European Parliament.
We also ask ISPs to immediately stop any filtering tests to serve the entertainment lobbies.

We remind to the SNEP, where a representative comes to criticize the decision of the European Parliament, he had only what he deserved: Several weeks ago, we were alerted about the pressure by his lobby at a European level.
A first, the consequence was the rejection by the Bono’s commission of the ultra-repressive Heaton-Harris amendments (filtering and unsubscribing).
A second consequence has been the filing of the Rocard amendment, who is voted now.
If this lobby continues in this current way, it should know that it could have a certain cost.

We would thank all the organizations that have been able to workagainst the lobbying entertainment industries, and we call urgently users to begin to prepare for a mobilization in the event that the government will not withdraw this text.

“DRI condemns backdoor implementation of surveillance laws”

Government proposals to introduce surveillance of all internet users are unacceptable. The proposed law will require Internet Service Providers (ISPs) to log details of every email, every instant message or chat message, and every time users log on or log off, and to store that information for up to 18 months. This information will then be available without any court order or warrant. These proposals, implementing European law, are being drafted without public consultation and would be implemented by a statutory instrument. There will be no scrutiny by the Oireachtas.

It is incredible that the Government proposes to introduce a law which would require every Internet user to be monitored without any warrant or prior judicial approval, without any public consultation and without any debate or vote in the Oireachtas. A law of this gravity should not be made by stealth.

The Department of Justice appears to be relying on the “urgency” of the matter to justify bypassing the Dail and Seanad. But the European law being implemented was passed in February 2006. The Department has had two years to introduce a Bill and it cannot rely on its own delay to justify sidelining democratic scrutiny.

In any case, it is inappropriate to implement this law whilst it is under court challenge. The Irish government itself has challenged the validity of the law before the European Court of Justice. Digital Rights Ireland has also brought a High Court action challenging the European law. These proposals will effectively pre-empt the judgment of the courts.

These agreements [1] envisage to cancel internet accesses for downloaders by the Digital Rights Regulation Authority (ARMT). We denounce this privatization of justice. Plus, the French State claims to create a database of the cancelled Net surfers, which is scandalous, but not surprising from a government which record always more informations on citizens and their ADN.[2]

The agreements force the FAI to start filtering internet, the very same way they do in China. Don’t mistake yourself: set up this filtering under cover of the protection of copyright, the president Sarkozy simply extends his media control, which is denounced by the trade unions of French journalists.[3]

France has reputation of European leader for internet control: the Minister of Interior Department, Michele Alliot Marie is known as favorable to the filtering requested by the European police chief Frattini in order to fight terrorism.[4]

Sarkozy methodically installs tools for information control on the web:
- prohibition to diffuse vidéos of police abuse on the French Net[5]
- pointing and tracing of the Net surfers by their logs of connection to Internet (anti-terrorist laws)[5]
- creation of a commission who will censure Internet for the profit of catholicm.[6]
- responsibility increasment for shelterers (LCEN2), therefore creation of a private web justice (the shelterers will have to judge the contents)[7]
- project of creation of a press label supposed to plug the “good sites of information”[8]

All these measurements draw a néo-Stalinist policy of control of information. Even within UMP it is denounced an attack with the fundamental principles of the Republic. Two deputies UMP, Marc Fur and Alain Suguenot condemned the fact of “aiming at creating a public authority which would be competent, on complaint of copyright owners, to take sanctions against the downloaders from internet access interruption to cancellation of the contract of access to the Web”, by specifying that: “This transfer of the habilities from a judge to an administrative authority means creating a true exception jurisdiction for downloaders and goes against the principle of equality in front of the law and the courts, principles fundamental of the laws of the Republic”.[9]

Even the method used by french government is scandalous :
It is the FNAC CEO, a CD and DVD salesman, which was selected to put forward these measures against freedom. The conflict of interest is obvious, and in addition opposite with the ethical charter of the group Pinault Printemps Redoute (group to which the FNAC belongs).[10]

Then, the French government handled the public opinion by using the media to say that a consensus has been obtained by Olivennes, whereas associations like Odebi, April, and stopDRM completely rejected liberticides measurements of the Olivennes mission when they were auditioned.[11]

We ask the Net surfers to fight néo-Stalinist measurements of Sarkozy by all the means available, in particular by the boycott of all the products of cultural industries and all the companies which carry reached to our freedoms.
