Noting a drift toward a surveillance society where freedom of expression and information is threatened, officials of many organizations throughout the world call for an action day on October 11, 2008.

Protest marches, festive events, workshops … Each country will participate in its own way to the action day “Freedom not Fear 2008″ [1]

In France, more and more organizations [2] prepare this day, and invites organizations defending privacy and freedom of expression and information to participate in this project [3]

Only a worlwide action can now fight against informational totalitarianism : More and more countries around the world are now joining this movement, which has yet to spread. We call all those who have contacts with activists of countries not yet participating to invite them to contact the Freedom not Fear coordination [4].

International Action Day “Freedom not fear - Stop the surveillance mania!” on 11 October 2008

A broad movement of campaigners and organizations is calling on everybody to join action against excessive surveillance by governments and businesses. On 11 October 2008, concerned people in many countries will take to the streets, the motto being “Freedom not fear 2008″. Peaceful and creative action, from protest marches to parties, will take place in many capital cities.

Surveillance mania is spreading. Governments and businesses register, monitor and control our behaviour ever more thoroughly. No matter what we do, who we phone and talk to, where we go, whom we are friends with, what our interests are, which groups we participate in - “big brother” government and “little brothers” in business know it more and more thoroughly.

The resulting lack of privacy and confidentiality is putting at risk the freedom of confession, the freedom of speech as well as the work of doctors, helplines, lawyers and journalists.

The manifold agenda of security sector reform encompasses the convergence of police, intelligence agencies and the military, threatening to melt down the division and balance of powers.

Using methods of mass surveillance, the borderless cooperation of the military, intelligence services and police authorities is leading towards new borders and walls, thus building true “Fortresses” in Europe and on other continents, directed against refugees and different-looking people but also affecting, for example, political activists, the poor and under-priviledged, and sports fans.

People who constantly feel watched and under surveillance cannot freely and courageously stand up for their rights and for a just society. Mass surveillance is thereby threatening the fabric of a democratic and open society.

Mass surveillance is also endangering the work and commitment of civil society organizations.

Surveillance, distrust and fear are gradually transforming our society into one of uncritical consumers who have “nothing to hide” and - in a vain attempt to achieve total security - are prepared to give up their freedoms. We do not want to live in such a society!

We believe the respect for our privacy to be an important part of our human dignity. A free and open society cannot exist without unconditionally private spaces and communications.

The increasing electronic registration and surveillance of the entire population does not make us any safer from crime, costs millions of Euros and puts the privacy of innocent citizens at risk. Under the reign of fear and blind actionism, targeted and sustained security measures fall by the wayside, as well as tackling peoples’ actual daily problems such as unemployment and poverty.

In order to protest against security mania and excessive surveillance we will take to the streets in capital cities all in many countries on 11 October 2008. We call on everybody to join our peaceful protest. Politicians are to see that we are willing to take to the streets for the protection of our liberties.

Our demands

1. Cutback on surveillance

* abolish the blanket logging of our communications and locations (data retention)
* abolish the blanket collection of our biometric data as well as RFID passports
* abolish the blanket collection of genetic data
* abolish permanent CCTV camera surveillance and automatic detection techniques
* scrap funding for the development of new surveillance techniques
* no blanket registration of all air travellers (PNR data)
* no information exchange with the US and other states lacking effective data protection
* no secret searches of private computer systems, neither online nor offline
* no blanket surveillance and filtering of internet communications (EU Telecoms-Package)

2. Evaluation of existing surveillance powers

We call for an independent review of all existing surveillance powers as to their effectiveness and harmful side-effects.

3. Moratorium for new surveillance powers

After the homeland armament of the past few years we demand an immediate hold to new homeland security laws that further restrict civil liberties.

4. Guaranteeing freedom of expression, dialogue and information on the Internet

* Ban the installation of filtering infrastructure on ISP networks.
* Only independent and impartial judges may request the removal of Internet content.
* Create a full right to quote multimedia, today indispensable to public debate in democracies.
* Protect common internet places of expression (participatory sites, forums, comments on blogs) today threatened by inadequate laws encouraging self-censorship (chilling effect)

« EDVIGE » : un fichier totalement hors la loi

Paris, 3 juillet 2008 — Privacy International, les Big Brother Awards France, Souriez vous êtes filmés et la Ligue Odebi s’associent aux communiqués publiés le 1er juillet par la LDH et par le Syndicat de la Magistrature alertant sur l’extême dangerosité du fichier Edvige.

Sans aucun débat public, ce fichier commun aux Renseignements Généraux et à la DST désormais réunies au sein d’une même agence de renseignements — la Direction centrale de la sécurité publique —, vient d’être « légalisé » par décret [1]. « Légaliser » est un bien grand terme puisque le recensement de la plupart des informations nominatives qui figureront dans ce fichier est formellement interdite par la loi Informatique et Libertés, sauf… si « la sureté de l’État » est en jeu [2]. Il incluera, en effet, des renseignements identitaires non seulement sur les « suspects » susceptibles de « troubler l’ordre public », mais aussi toutes les notes propres au travail de renseignement comme les opinions politiques, religieuses, la sexualité, les origines ethniques, les appartenances syndicales et associatives. Les personnes mineures ne seront pas épargnées non plus puisque Edvige ciblera également les jeunes à partir de 13 ans.

On peut se demander aujourd’hui si l’état fait encore une quelconque différence entre « suspect » et « délinquant », entre « capable du fait » et « condamné ». Et si l’atteinte hypothétique à la « sûreté de l’État » – incluant des actes tels que aider les enfants de sans-papiers, se rebeller contre une autorité policière excessive, ou ne pas vouloir d’OGM dans son assiette – peut, dans une démocratie, servir de prétexte à la constitution d’un tel fichier. Il n’est pas sans rappeler les fiches du ministre Foucher qui comportait renseignements, dénonciations et calomnies sur tout individu suspecté de ne pas être un bon sujet de l’Empire.

Les BBA France déplorent à nouveau l’impuissance de la CNIL [3] à empêcher la constitution d’Edvige. Elle est largement due aux modifications de la loi Informatique et Libertés avalisées par son rapporteur et Président Alex Turk et à sa dépendance financière aux deniers de l’Etat. Ils dénoncent également l’absence de réaction du Conseil d’Etat, qui a forcément été consulté sur un tel texte.

La seule attitude démocratique consiste à s’opposer massivement à ce fichage abusif et dangereux, qui nie à une certaine catégorie de personnes tout droit, en particulier à la vie privée. Les personnes, délinquantes avérées ou potentielles et les militants contestataires, tout commes les criminels et les terroristes, sont des êtres humains auxquels sont dus les droits fondamentaux garantis à tous par la Constitution et les Déclarations des Droits de l’Homme. Les BBA France s’associeront à toutes les associations qui oeuvreront pour faire valoir ces droits et demander la suppression du fichier Edvige.

National Petition for withdrawal of the pupil filing in the 1st degree

BBA France / Correso, January 22, 2008.- The Big Brother Awards join an initiative of parents, teachers and activists of Human Rights to obtain the withdrawal of a computer file supposed to file all students from 3 years; a file that has become widespread in all kindergartens and schools at the beginning of 2009.

Launched at the initiative of Correso, the social resistance collective of Rennes - which was one of the first groups of citizens to denounce the excesses of “student database” - this petition has already collected more than 200 signatures of personalities from the world of education, philosophy, pediatrics and psychology, as Albert Jacquard, Jacques Testart, Laurent Ott, Hubert Montagné, as well as representatives of associations involved in the protection of children and the welfare.

Recall that it was in Rennes that the first school directors (assuming also, in most cases the teaching profession), have protested against this precocious filing children. An action that has been distinguished by the last BBA jury by giving them the Voltaire award 2006.

In a lengthy document published last summer in connection with this action include (at end of article) copies of official documents that preceded the creation - “experimental” at first - of this file in early 2005; partial documents that are out of anonymity due to the insistence of journalists and not thanks to the desire for transparency of the authorities.

One final note, it is under pressure from the teachers, parents and union activists that the Ministry of National Education has decided, in late 2007, to delete some fields and irrelevant issue with the “educational” purpose of that file (data on children of foreign parents, in particular), which is the harbinger of worse on the next evolution of this file at the whim of repressive policies involving undocumented persons and those in the midst of insecurity. Possible crosses can be seen for example with the new file “Eloi”, formalized in December 2007.

A recent parents consultation, innocuous at first sight, on their language and culture of origin could prove too significant risk of diversion without any purpose with the intention (source: Toulon LDH).
