Hadopi law has been quickly promulgated by the french government, who thinks for more than two years that the less a law is politically and economically viable, the more faster it must be applied.

The content of this repressive law has been emptied by the Constitutional Council, then the Hadopi law without the graduated response becomes a monitoring and spam machine will nevertheless run and give power to justice authorities.

The question of justice independence just remains.
Could they act smoothly ? while this administrative authority will be the point of denunciations of a political nature ?

Should we not fear that business related to download could become a priority, under the pressure of the executive corp and its privileged proximity to the lobbies ?

A new project Hadopi 2 regarding the legal sanctions should be submitted by the Council of Ministers in the coming weeks.

The blindness of the government to reject any other solution in the framework of a democratic debate and the collusion between the government and the lobbies, show the importance of civic vigilance more than ever.

We can only deplore this obstinacy.
Without extended ourself longer about the slap inflicted by the Constitutional Council to this bad scheme, the government has lost an amazing opportunity to rethink Culture and Creation in the new digital internet space.

We are looking at a worrying division of a part of the art world and its audience and we are sad about this, we understand that division, because it is legitimate for artists to expect for a fee, but the audience should have free access to Culture too.

We regret that the government only concern is the violation of copyright and protection of intellectual property that should be reconsidered, when common sense urged everybody to seek for new ways.

While the government would have been legitimate to support a global unique cultural movement concerning new technologies, it gives weapons to dig the hole already dug by the Majors companies, and gives the death to themself and to the culture industry as well.

The decision of the French Constitutional Council of the last June 10 was one more victory for digital freedoms, after the election of the first Pirate Parliament Euro-deputy.

Censorship of the principle of graduated response by the Constitutional Council was intelligent decision.
This decision is from our point of view legitimate and justified.
By upholding the appeal filed against the law “Creation and Internet”, the Constitutional Council reinforces many of our convictions.

Indeed, the privacy is at the heart of the concerns of the Pirate Party.
Monitoring of Internet connections is a breach of human rights and citizens, especially the universal right to expression and communication. Communicating is a vector of development for all and should be accessible to everyone and it can deprive citizens without solid legal basis.
History has shown that botched justice is nonsense and does the resentment of citizens.
The Constitutional Council has agreed that all sanctions must be taken by a judge and not by a pseudo public administrative entity controlled by lobbyists. The independent justice has won the fight against the principle of “judge and party.”

The recognition of the right to access the Internet as a human right is a historic event. We are still facing to the consequences of that decision by extending this recognition to the right of free sharing of culture. This right goes hand in hand with the remuneration of artists, which is not fully secured by intellectual property, since very few artists are paid.

Respect for the presumption of innocence is another important point in this decision. By making the proof beared by the internet owner (with all abuses as consequence, government spyware and other), the legislature has violated this principle and it is only right if this part of the law has been simply censored.

Today, the Law “Creation and Internet” is emptied of substance but the government refuses to see the reality. How much defeat must it takes in order to make the government understand that this law is a failure ?
We will remain vigilant on the way that this affair could go.
The government will have again many opportunities to interfere with the freedoms of Internet users, we must remain each time mobilized to resist facing the surveillance of networks.

Let’s talk about the future now. The law known as Loppsi 2 is coming and probably the Government will make it an emergency, which would lead him back to the vote of simplified botched procedures that everyone knows. We still have a chance to prevent this law from passing. We need to alert and inform citizens about the risks that exist when filtering the Internet, so that France will never look like China. We must defend our digital freedom, which are fundamental, and act.
This government has no legitimacy to restrict civil and digital liberties.

The Pirate Party needs new forces to spread the need of justice and freedom.
We are calling all the pirates of France to fight under the banner of the 3 historical points of the International Pirate Party : Reform of Copyright, Free movement of scientific knowledge and promotion of Human Rights.

This election is a victory for the International Pirate Movement, which will finally be able to disseminate its ideas into politics and media in a legitimate way.

We can see a positive sign of conscience and a hope for the universal dissemination of cultural works, the free flow of scientific knowledge and respect of fundamental rights of citizens.

Pirate Party ideas are full of potential, innovation and imagination, they are likely to deeply change political and economic dogma. They are particularly useful today and are expected to spread across the globe.

The Earth can no longer simply focus on an economic development without rationality or limits..

Culture gives a sens to our lives, education gives a leadership, and as such, they are top priorities for sustainable human development.

Press release 04/23/2009 : from the Pirate French Pirate Party historical channel

The French Pirate Party historical channel gives all its support to the administrators of the The Pirate Bay website, sentenced to a year of jail and told to pay 3 million Euro of damages in unworthy conditions of a State of law.

The FPPch condemns firmly the interference of copyright lobbies in state justice and democratic process.

After the revelation of links between the judge Thomas Norström and the intellectual property lobbies, FPPch asks the cancellation of The Pirate Bay sentence according to the Right of a fair trial.

The membership of the Svenska föreningen för upphovsrätt (Swedish association for the Copyright), and being councilman of Svenska föreningen för industriellt rättsskydd (Swedish Association for the Protection of Industrial Property) is obviously not compatible with the function of judge in The Pirate Bay lawsuit, because of a conflict of interest.

The judge Norström, by being member of these lobbies as are the counsels for the prosecution Henrik Pontén, Peter Danowsky and Monica Wadsted, who represented the disc and movie industry during all litigation, is corrupted.

Any other decision than the cancellation of this judgment would be a denial of justice and democracy.

The Pirate Party French-historical channel makes common cause with the Swedish Pirate Party in their battle for the broadcasting of culture to all.

The FPPch calls all actors of the web and political life to unite at European level to report the corruption of parliamentarians and judges by lobbies.

Finally, FPPch calls all French web-users to rally against the Hadopi law and to express their opposition in the whole country on Saturday, April 25th.

Pourquoi un Parti Pirate ?

L’information, la culture et le savoir sont aujourd’hui à portée de tous grâce aux facilités d’accès des réseaux Internet. Cependant, les puissants de ce monde n’acceptent pas que les peuples s’informent librement, ni qu’ils accèdent gratuitement à la culture, au savoir et à la technologie. La société de consommation, soutenue par les lobbies les plus cupides, est ainsi un mode de gouvernance fondé sur l’asservissement par l’ignorance. Nos libertés fondamentales sont bafouées par des politiques sécuritaires et répressives. Les internautes sont tous devenus des suspects potentiels. Non seulement les filtrages et le fichage des internautes s’intensifient, mais en plus des sanctions disproportionnées sont prévues. Ces sanctions condamnent les contrevenants, sans même un jugement, à de lourdes peines s’appliquant à toute la famille . Ces méthodes d’un autre âge ont des conséquences sur la vie professionnelle, publique et privée de chacun d’entre nous. Ces éléments laissent craindre une régression démocratique, orchestrée par les élites d’aujourd’hui, héritières des élites d’hier, inquisiteurs et dictateurs.

Release Odebi 27-10-2008: Call the french senators to reject the graduated response!

ODEBI sent the following message to the french senators, and calls all internet users to ask the french senators to reject the graduated response:

French senators must realize that the graduated response is a repressive mechanism totally contrary to the most basic rights of citizens:

- Every citizen has the right to a fair trial before any penalty: it is the independent and impartial judge, and he alone, which is the guardian of freedoms.

- Freedom of expression and information is a fundamental right: it is scandalous that the Committee of Cultural Affairs of the Senate tries to deny it by saying that no european text says that Internet access is a fundamental right . The internet access allows to exercise this freedom of expression and information: terminating access is therefore a clear violation of this freedom. This punishment is completely disproportionate.

- The Committee of Cultural Affairs said that only the “home” access will be terminated: it is therefore a familial punisment. No democracy can accept the infliction of such collective punishment, which was recalled by the former french prime minister Michel Rocard on 22 April 2008: “For me, the possible cutoff of the Internet is a collective punishment prohibited by all our systems of law. The meaning of the laws is clear and there is no sophisticated problem to understand that. ”

French senators must ensure that:

- Only the judge can decide on a punishment.

- Terminating access of families, ie imposing a collective punishment, must be clearly prohibited.

Noting a drift toward a surveillance society where freedom of expression and information is threatened, officials of many organizations throughout the world call for an action day on October 11, 2008.

Protest marches, festive events, workshops … Each country will participate in its own way to the action day “Freedom not Fear 2008″ [1]

In France, more and more organizations [2] prepare this day, and invites organizations defending privacy and freedom of expression and information to participate in this project [3]

Only a worlwide action can now fight against informational totalitarianism : More and more countries around the world are now joining this movement, which has yet to spread. We call all those who have contacts with activists of countries not yet participating to invite them to contact the Freedom not Fear coordination [4].

International Action Day “Freedom not fear - Stop the surveillance mania!” on 11 October 2008

A broad movement of campaigners and organizations is calling on everybody to join action against excessive surveillance by governments and businesses. On 11 October 2008, concerned people in many countries will take to the streets, the motto being “Freedom not fear 2008″. Peaceful and creative action, from protest marches to parties, will take place in many capital cities.

Surveillance mania is spreading. Governments and businesses register, monitor and control our behaviour ever more thoroughly. No matter what we do, who we phone and talk to, where we go, whom we are friends with, what our interests are, which groups we participate in - “big brother” government and “little brothers” in business know it more and more thoroughly.

The resulting lack of privacy and confidentiality is putting at risk the freedom of confession, the freedom of speech as well as the work of doctors, helplines, lawyers and journalists.

The manifold agenda of security sector reform encompasses the convergence of police, intelligence agencies and the military, threatening to melt down the division and balance of powers.

Using methods of mass surveillance, the borderless cooperation of the military, intelligence services and police authorities is leading towards new borders and walls, thus building true “Fortresses” in Europe and on other continents, directed against refugees and different-looking people but also affecting, for example, political activists, the poor and under-priviledged, and sports fans.

People who constantly feel watched and under surveillance cannot freely and courageously stand up for their rights and for a just society. Mass surveillance is thereby threatening the fabric of a democratic and open society.

Mass surveillance is also endangering the work and commitment of civil society organizations.

Surveillance, distrust and fear are gradually transforming our society into one of uncritical consumers who have “nothing to hide” and - in a vain attempt to achieve total security - are prepared to give up their freedoms. We do not want to live in such a society!

We believe the respect for our privacy to be an important part of our human dignity. A free and open society cannot exist without unconditionally private spaces and communications.

The increasing electronic registration and surveillance of the entire population does not make us any safer from crime, costs millions of Euros and puts the privacy of innocent citizens at risk. Under the reign of fear and blind actionism, targeted and sustained security measures fall by the wayside, as well as tackling peoples’ actual daily problems such as unemployment and poverty.

In order to protest against security mania and excessive surveillance we will take to the streets in capital cities all in many countries on 11 October 2008. We call on everybody to join our peaceful protest. Politicians are to see that we are willing to take to the streets for the protection of our liberties.

Our demands

1. Cutback on surveillance

* abolish the blanket logging of our communications and locations (data retention)
* abolish the blanket collection of our biometric data as well as RFID passports
* abolish the blanket collection of genetic data
* abolish permanent CCTV camera surveillance and automatic detection techniques
* scrap funding for the development of new surveillance techniques
* no blanket registration of all air travellers (PNR data)
* no information exchange with the US and other states lacking effective data protection
* no secret searches of private computer systems, neither online nor offline
* no blanket surveillance and filtering of internet communications (EU Telecoms-Package)

2. Evaluation of existing surveillance powers

We call for an independent review of all existing surveillance powers as to their effectiveness and harmful side-effects.

3. Moratorium for new surveillance powers

After the homeland armament of the past few years we demand an immediate hold to new homeland security laws that further restrict civil liberties.

4. Guaranteeing freedom of expression, dialogue and information on the Internet

* Ban the installation of filtering infrastructure on ISP networks.
* Only independent and impartial judges may request the removal of Internet content.
* Create a full right to quote multimedia, today indispensable to public debate in democracies.
* Protect common internet places of expression (participatory sites, forums, comments on blogs) today threatened by inadequate laws encouraging self-censorship (chilling effect)

<< "Il faut contrôler des ressortissants bosniaques, roumains, ainsi que des individus originaires des pays de l'Est", c'est ce que conseille, noir sur blanc, un document distribué à tous les commissariats de l'ouest parisien. Un fichier secret serait aussi en vigueur. Contrôle au faciès ? Fichage racial ? Totalement illégal en tous les cas... Mais qui s'en soucie ?

Reportage au 19/20 de France 3, le 25 juin 2008. Un document est distribué dans tous les commissariats de l'est parisien, avec consigne de contrôle au faciès et mention d'un fichier secret rassemblant des informations raciales. >>
